Acceptance of Terms

By accessing, booking, or using the services of Aero Divine Aviation Private Limited (“Aero Divine”), you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions. If you do not agree, please refrain from using our services.

Booking, Availability & Payment

  • All bookings are subject to aircraft availability and final confirmation.
  • 100% advance payment is required to reserve and block the helicopter.
  • As a standard payment term, 50% of the amount is payable at the time of booking and the remaining 50% must be paid at least 30 days prior to the scheduled flying date.
  • Receipt of advance payment does not guarantee availability until formally reconfirmed by Aero Divine.
  • Aero Divine reserves the right to substitute the helicopter model based on operational availability.
  • All prices are quoted in Indian Rupees (INR)unless stated otherwise and may vary due to demand, seasonality, or operational factors.

Permissions & Regulatory Compliance

  • Landing and take-off permissions for helipads (other than licensed airfields), including certified coordinates and special permissions for activities such as flower dropping, must be obtained by the client at their own cost from local authorities / District Collector.
  • All permissions must be submitted to Aero Divine at least 24 hours priorto commencement of flying operations.
  • All flight operations are subject to DGCA regulations, ATC clearance, airworthiness of the aircraft, weather conditions, and satisfactory load & trim. The Pilot-in-Command (PIC)shall have final authority.

Ground Arrangements & Safety at Helipads

  1. The client must arrange, at their own cost:
    • Fire tender
    • Ambulance
    • Security personnel
    • Barricading and crowd control
    • Water sprinkling to control dust during landing and take-off
  2. Inadequate arrangements may result in the Pilot-in-Command refusing to land or operate from the helipad.
  3. Proper crowd control is mandatory at all helipads; failure may lead to cancellation or diversion without liability on Aero Divine.

Parking, Night Halt & Crew Facilities

  • If overnight parking and security at a location are deemed unsatisfactory, the helicopter shall be re-positioned to the nearest airport. Additional flying time and airport charges will be billed to the client.
  • For night halts, the client must provide 4 or 5-star accommodation, local transportation, and meals for crew members.
  • Alternatively, 25,000 per night per crew will be charged.
  • For halts exceeding 3 hours, the client shall arrange suitable rest facilities, meals, refreshments, and local transport for crew.

Passenger Requirements & Weight Limitations

  • Valid government-issued photo identification is mandatory for all passengers.
  • All foreign nationals / NRIs must carry valid passports and visas.
  • Average passenger weight must not exceed 80 kg. If exceeded, passenger capacity may be reduced.
  • Final authority regarding passenger load rests solely with the Pilot-in-Command.
  • Maximum hand baggage allowance is 5 kg per passenger.
  • Intoxicated passengers or those under the influence of drugs will be denied boarding.

Baggage Policy

  • Baggage allowance varies by aircraft type.
  • Excess baggage may attract additional charges.
  • Prohibited items as per aviation security regulations are strictly forbidden.
  • Aero Divine shall not be responsible for loss or damage to baggage beyond statutory limits.

Charges, Fees & Taxes

  • Special landing charges at helipads, airfields, or airports shall be charged extra.
  • Fuel transportation costs will be charged on an actual basis.
  • Landing, parking, and passenger handling charges levied by AAI, DIAL, Indo-Thai, or any ground handling agency shall be billed additionally.
  • GST @ 18%(or as applicable from time to time) shall be charged extra.
  • Any additional flying time for any reason shall be charged over and above the agreed amount.
  • Flying time shall be calculated from Rotor-On to Rotor-Offas per industry norms.

Flight Operations & Limitations (DGCA Compliance)

  • All flight operations shall be conducted strictly in compliance with applicable DGCA Civil Aviation Requirements (CARs), AICs, NOTAMs, and operational circulars.
  • Aero Divine maintains an approved Operations Manual, Safety Management System (SMS), and Maintenance Control procedures as mandated by DGCA.
  • The Pilot-in-Command retains absolute authority to delay, divert, or cancel any flight in the interest of safety or regulatory compliance.
  • No flight shall be operated unless aircraft airworthiness, crew duty limitations, weather minima, and load & trim requirements are fully satisfied.

Regulatory & Audit Compliance

  • All charter operations are subject to surveillance, inspection, and audit by DGCA or any other statutory authority.
  • The client agrees to comply with all safety, security, and operational instructions issued by Aero Divine in accordance with DGCA norms.
  • Any deviation requested by the client that is contrary to DGCA regulations shall be deemed void and shall not be undertaken.
  • All flights are subject to weather conditions and operational feasibility.
  • Aero Divine reserves the right to delay, reschedule, divert, or cancel flights in the interest of safety.
  • No compensation shall be payable for delays or cancellations due to weather, ATC restrictions, or circumstances beyond Aero Divine’s control.
  • As Aero Divine operates single-engine helicopters, carriage of any VVIP / VIP passenger as defined under DGCA CAR is strictly prohibited.

Flower Dropping Operations

  • Only flower petals are permitted during flower-dropping operations.
  • Flowers must be supplied by the client at their own cost.
  • All required permissions must be obtained in advance by the client.

Prohibited Activities & Conduct

  • Aerial photography from the helicopter is strictly prohibited and illegal.
  • Smoking, consumption of alcohol, or use of electronic cigarettes onboard is forbidden.
  • Carriage of dangerous goods including explosives, corrosives, or hazardous materials, is not permitted.
  • Disruptive behaviour or non-compliance with crew instructions may result in denial of service.

Insurance & Liability

  • Passenger insurance coverage shall be as per DGCA regulations.
  • Aero Divine’s liability is limited in accordance with applicable aviation laws.
  • Passengers are advised to arrange their own travel insurance for additional coverage.
  • Aero Divine shall not be liable for indirect or consequential losses.

Cancellation & Refund Policy (Aligned with Indian Contract Law)

  1. Cancellation charges shall apply on the blocked flying amount as liquidated damages, being a genuine estimate of losses incurred:
    • Up to 45 days prior to scheduled flight: 25% deduction (75% refundable)
    • 31–44 days prior: 50% deduction (50% refundable)
    • 16–30 days prior: 75% deduction (25% refundable)
    • 15 days or less: 100% deduction (No refund)
  2. An administrative charge of 50,000 towards flight planning, crew rostering, regulatory filings, and aircraft positioning shall be applicable where cancellation occurs due to force majeure or technical reasons at the point of origin.
  3. No refund shall be payable for third-party or pass-through costs already incurred, including but not limited to government permissions, helipad development, landing/parking charges, fuel logistics, security arrangements, accommodation, or handling agency fees.
  4. In the event landing or operational permission is denied by any authority, refunds (if any) shall be processed strictly in accordance with this clause after deduction of expenses incurred.
  5. Advance payments once received are non-refundable, except where non-performance is solely attributable to Aero Divine and no cost has been incurred.
  6. No refund shall be admissible where operations are restricted or prohibited by government orders, NOTAMs, pandemics, or force majeure events.
  7. Where flight operations are discontinued from the point of origin due to adverse weather conditions, 50% of the blocked flying time, after deduction of incurred expenses, shall be refundable.
  8. All eligible refunds shall be processed within 30–60 working daysfrom the date of written cancellation request.

Privacy & Data Protection

  • Personal information shall be collected and used in accordance with Aero Divine’s Privacy Policy.
  • Data may be shared with regulatory authorities as required by law.
  • Appropriate security measures are implemented to protect personal data.

Governing Law & Jurisdiction

  • These Terms & Conditions shall be governed by and construed in accordance with the laws of India.
  • Subject to applicable laws, courts at Patna, Biharshall have exclusive jurisdiction over all disputes arising out of or in connection with these Terms & Conditions.

Modifications

Aero Divine reserves the right to modify these Terms & Conditions at any time without prior notice. Continued use of services shall constitute acceptance of the revised terms.
